Why do I need a title search?
A title exam is a methodical search through public records to uncover
any recorded legal interests in the property. Any purchaser or lender
should be certain that the seller has the legal right to sell the property
and that the property is unencumbered by liens or other legal issues.
A thorough review of the county records will provide information to the
purchaser, seller, lender, attorney, and all other parties of interest,
regarding the marketability of property. Without proper and accurate title
examinations, all parties could be subjecting themselves to future liability
and/or losses.
Title examiners will document any relevant issues found in the county
records including the following:
- If there are any materialmen liens against the property.
- How many Security Deeds are outstanding against the property.
- Whether the homeowners association filed a lien for non-payment.
- Whether the seller actually owns the property.
- Have there been any liens filed against the property by city, county,
or state authorities.
- Are there any federal, state or local income tax liens filed against
this property.
- If the owner of the property is deceased, who has been appointed as
executor?
- What did the Seller pay for the property when they originally purchased
the property?
- If this property is being “flipped,” the process of buying
and selling extremely quickly.
- If any property tax liens have been filed against the property.
- If there are any easements on the property.
- Lawsuits against the owners which could affect the property.
- Any questionable transactions requiring further investigation
